The Licensing
Authority, as a responsible authority, supports the adjournment request
submitted by the Metropolitan Police Service and believe it is in the public
interest to adjourn the hearing as the holding of additional licences has the
potential to undermine the sanctions available to responsible authorities in
response to a review application under the Licensing Act 2003. This would be the
case if action was taken in respect of one of the licences in effect at the
premises, but the premises continued to operate under the authority of a second
licence which had not been affected by the review proceedings because it has
been granted just days before the review hearing.
Such concerns
formed the basis of the Licensing Authority’s representation to the shadow
licence application for 21 Rupert Street in the first instance.
Given that
there is outstanding review proceedings for 21 Rupert Street, it is believed it
is in the public interest to adjourn the hearing of the shadow licence
application until after the review hearing on Monday 23 September so as not to
undermine the review proceedings and interim steps taken by Licensing
Sub-Committee on 30 August 2019 to suspend the existing premises licence.
The Licensing
Authority would appreciate that the above be circulated and put before the
Chairman as the Licensing Authority’s submissions to the adjournment request of
this application at Thursday’s hearing.

Thank
you for your email and letter received this morning.
Police
Licensing requested an adjournment to the forthcoming Hearing for an
application proposing a shadow licence for the Basement 21 Rupert Street on
behalf of the Landlord, to which Police have objected. As you are aware Police
have commenced Review proceedings against this premises due to an incident of
serious crime and disorder in August. A full Hearing is being heard on the 23rd
September to decide what action is to be taken regarding the existing premises
licence and therefore the final outcome will be of significant importance as to
whether a shadow licence should be granted.
The
Council’s preference would be a Hearing date at some time following publication
of the result of the Review proceedings.
This request was supported by the Licensing Authority.
The
Licensing Authority has the power to adjourn the hearing of your Client’s
application under Regulation 11(1) of the Licensing Act 2003(Hearings)
Regulations 2005 where it considers it is in the public interest.
However,
as the Applicant opposes the adjournment, the Licensing Sub-Committee will
determine whether the application should or should not be adjourned as a
preliminary issue on Thursday 19 September 2019.
Please send the Council your submissions for opposing the application by 5.pm
today so that these can be circulated to all Parties in advance of the
hearing.
The
Council requests that all parties are to submit their submissions by 5pm today.
